Terms of Service — The Peak Daily

These Terms of Service (“Terms”) govern your use of The Peak Daily mobile application and website (the “Service”) operated by Rank Brain Media LLC (“we,” “our,” or “us”). By using the Service, you agree to these Terms.

Description of Service

The Peak Daily is a local information application for Apex, NC. It provides event listings, town alerts, utility outage information, business directories, school calendars, trash and recycling schedules, AI-powered Q&A, and other community-focused features.

Subscriptions

The Service offers auto-renewing subscriptions at $3.99/month or $39.99/year. All subscriptions include a 7-day free trial for new users.

Payment is charged to your Apple ID or Google Play account at confirmation of purchase (after the trial period ends).
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
You can manage or cancel your subscription in your device's App Store or Google Play settings.
No refunds are provided for partial billing periods.

Content Accuracy

We make our best effort to provide accurate, up-to-date information about events, town operations, business listings, and other local data. However, we do not guarantee the accuracy, completeness, or timeliness of any information provided through the Service. Always verify critical information (such as meeting times, emergency alerts, or utility schedules) with official town sources.

AI Chat

The AI chat feature provides responses based on publicly available information about Apex, NC. Responses are generated by artificial intelligence and may contain errors. AI-generated answers should not be relied upon as legal, medical, financial, or emergency advice.

User Conduct

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Attempt to scrape, harvest, or extract data from the Service through automated means
Abuse, harass, or submit harmful content through the chat or community features
Interfere with or disrupt the Service or its infrastructure
Share your account credentials with others

Intellectual Property

All content, design, code, and data within the Service is owned by Rank Brain Media LLC or its licensors. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

Limitation of Liability

To the fullest extent permitted by law, Rank Brain Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting adam@thepeakweekly.com.

Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions.
